1. GENERAL RULES
1.1 WHO WE ARE AND APPLICATION OF THESE GENERAL RULES
- ‘Pointsbet.com’ is the betting name of PointsBet Australia Pty Limited (hereafter ‘PointsBet’, ‘we’, ‘our’ or ‘us’), ACN 606 814 920, a company incorporated in Australia under the Corporations Act 2001 (Cth.) PointsBet is licensed in the Northern Territory (‘NT’) by the Northern Territory Racing & Wagering Commission ('NTRWC’) to accept bets and wagers (together ‘bets’) by electronic transmission, 24 hours per day. PointsBet complies with the NT Code of Practice for Responsible Online Gambling and the South Australian Responsible Gambling Code of Practice.). All references to ‘we’, ‘us’ and ‘our’ in these General Rules (‘Rules’) are a reference to PointsBet.
1.2 GENERAL
- To open a betting account with PointsBet (‘Account’) you must be aged 18 years or older. A ‘Member’ is a person who has applied to open an Account who has subsequently been identity verified by PointsBet in accordance with Rule 1.4 (Identification Requirement) and is subsequently provided an Account. Any reference to ‘you’ or ‘your’ in these Rules is a reference to a Member.
- You agree that the service offered by www.pointsbet.com is the ability to place a bet, win or lose.
- By applying to open an Account, you are deemed to have read and accepted these Rules and PointsBet’s Privacy Policy. You can view our Privacy Policy on our website located at www.pointsbet.com.au, any pages or websites under the ‘PointsBet’ brand and any PointsBet mobile phone or tablet applications that are owned and/or operated by us (‘Website’) or by clicking on this link https://pointsbet.com.au/privacy. The personal information (as defined by the Privacy Act 1988) of PointsBet's customers may only be stored, accessed, used or disclosed offshore where such storage, access, use or disclosure is in accordance with all Australian laws, including the Privacy Act 1988, and PointsBet's Privacy Policy.
- PointsBet reserves the right to change, amend or add to these Rules and the Privacy Policy at our discretion, and will publish such changes on our Website. You agree that any changes, amendments or additions published on our Website will be taken to be effective immediately. It is the Member’s responsibility to ensure that they are aware of the current Rules and Privacy Policy.
- These Rules are intended to contain all the terms of our agreement with you in relation to your betting. If a member of staff has made a statement to you that is not covered by or is at variance with any provision of Rules you should inform Customer Services immediately before you commence betting with us. We warn you that the law favours written terms and it is therefore important that you bring any such statements to our attention before you commence your betting with us.
- You warrant that you are legally able to visit, use or otherwise participate through the Website from the jurisdiction where you are currently located. You accept that if we detect activity which indicates to us that you are or may be within a Restricted Jurisdiction and are or may be betting on your Account, we may, in our discretion, either suspend or permanently close your Account and/or cancel all bets we deem to have been placed from within a Restricted Jurisdiction. You accept that the data available to monitor betting on an Account is not always accurate and PointsBet will use its discretion in accepting any bets on your Account while conducting any investigation.

These messages may be sent via different channels, including by email, SMS and telephone. You may opt-out of receiving these messages (either altogether or via a particular channel) at any time by contacting our Customer Service team and updating your contact preferences, or by using any other unsubscribe facility we provide, in accordance with these Rules and any other applicable Terms and Conditions.
- By opening an account, you acknowledge and agree that PointsBet may, in accordance with applicable laws or regulations or otherwise by using its discretion, places restrictions, limits or caps at any time (and for any reason) on the amount of deposits that you may make into your account.
- We may appoint a relationship manager to help manage your interactions with PointsBet. Subject to your contact preferences, your relationship manager may communicate with you by email, SMS or phone. Some of these messages may include marketing and promotional material. However, given the personalised nature of these messages, you acknowledge and agree that they may not include an ‘unsubscribe’ or ‘stop’ mechanism. If you wish to stop receiving these messages, you can opt-out or change your contact preferences at any time by replying to the message with the words OPT OUT or otherwise informing your relationship manager or our Customer Service team directly. If you no longer wish to have a relationship manager for your interactions with PointsBet, you can let us know by either informing your relationship manager directly or by contacting our Customer Service team.
1.3 MEMBER OBLIGATIONS
- Members are responsible for ensuring that their Account details such as their address, telephone number, email address and payment/bank details (including any debit card expiration details) are kept up to date and to notify us immediately of any incorrect Account details. In the event that a Member has not kept their Account details up to date, we reserve the right to suspend the Account. Members are responsible for complying with their own local, national or state laws concerning betting prior to either applying to become a Member or placing a bet on their Account. Only Australian Residents are eligible to open an account with PointsBet. You agree that you shall not open an Account, nor attempt to use your Account, if you not an Australian resident.
- We periodically monitor transactions on Accounts. You accept that if we detect activity which indicates to us that you are not an Australian resident, we may, in our discretion, either suspend or permanently close your Account. You accept that the data available to monitor betting on an Account is not always accurate and PointsBet will use its discretion in accepting any bets on your Account while conducting any investigation.
- In the event that PointsBet discovers that an Account has been opened by someone who resides in a Restricted Jurisdiction, PointsBet may in its discretion close the Account and request proof of payment method, personal identification and bank account information prior to permitting a withdrawal of the original funds. Winnings may be forfeited if the Account holder opens the Account contrary to these Rules.
- Where a person successfully applies for an Account with PointsBet, the Member must then comply with the matters set out in Rules 1.4.1 to 1.4.10 (inclusive) to our satisfaction to fully activate their Account and withdraw funds.
- A Member must immediately notify PointsBet of any matter (including any potential mental impairment) which may lead us to reasonably infer that your ability to make sound judgments about betting
1.4 MEMBER IDENTIFICATION REQUIREMENTS
- Only persons over 18 years of age may apply to open an Account. PointsBet reserves the right to ask for proof of age from any applicant or Member and, if a already a Member, suspend their account until satisfactory documentation is provided. Applicants and/or Members are required to provide PointsBet with sufficient identification information to enable PointsBet to comply with its various legislative and regulatory obligations including those in respect of the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and all related regulations, rules or similar (‘Act’.) The Act sets out Australian Government standards for identity verification in relation to (without limitation) proof of name, age and residential address. PointsBet is required to comply with the Act and must consider this information for the purposes of application to open an Account.
- As s of 29 September 2023, PointsBet is required by the Act to verify an applicant’s ‘identification information’ (‘ID’) (including your full name, residential address and date of birth) before the applicant can be issued an Account and become a Member. PointsBet may also be required to re-verify a Member’s identity at any time after being issued an Account. Applicants who do not provide full and accurate details on sign up will not be issued an Account until that applicant’s identity is later verified by PointsBet – by applying for an Account, applicant’s agree that PointsBet may contact them by any means for the purpose of verifying the applicant’s identity. If PointsBet is unable to re-verify at Member’s identity at any time (or for any reason) then, without notice, PointsBet will immediately suspend that Member’s account pending an investigation.
- The 'identification information (‘ID’) that PointsBet requires in order to verify your identity includes (without limitation) your full name, residential address (‘address’) and date of birth, as provided to PointsBet upon applying for your Account.
- By agreeing to these terms and conditions and applying to open an Account or subsequently holding an Account, applicant’s and Members acknowledge and agree that at any time after application and/or opening of the Account, PointsBet is entitled to conduct any and all such identity verification using your ID, credit and other verification checks from time to time that PointsBet may require and/or is required by applicable laws and regulations such as (without limitation) the Act and/or by the relevant regulatory authorities for use of our products and services. You agree to provide all such information as PointsBet requires in connection with such identity verification checks. If already a Member, PointsBet shall be entitled to suspend or restrict your Account in any manner it considers appropriate, until such time as the relevant checks are completed to its satisfaction. Applicant’s and Members accept and agree that PointsBet uses third parties for identity verification, and that ID will be supplied to such third parties (including without limitation Equifax, Experian, ComplyAdvantage, Sardine AI, DVS, Onfido and GBG Group plc (‘GBG’)) for the purpose of identity verification, which may involve checking the Member’s ID against those third party databases and/or credit headers. Unfortunately, the verification process available is not perfect and we cannot verify 100% of applicants and/or Members this way. If unable to complete identity verification using third parties, PointsBet may work directly with the applicant and/or Member to do so. PointsBet may also use other public information services to confirm a Members’ identity and comply with any of its legislative and regulatory obligations.
- PointsBet may also require proof of a applicant and/or Member’s current address, and by applying for or holding an Account you agree to provide such proof on request by PointsBet. If the Member’s address is not on the front or back of one of the types of photographic identification referred to in Rule 8, the Member must provide proof of current address acceptable to PointsBet. Acceptable proof of current address in such circumstances may include, at PointsBet’s discretion, a certified copy of one or more of the following documents (which must be dated no more than 3 months prior to the date that the Member provides the document to PointsBet): a. a rates notice; b. a utility bill; or c. a statement from a financial institution.
- You are only required to send in ID documents to verify your identity if PointsBet’s initial identity verification process is not successful. PointsBet may attempt to contact you if you are required to do anything to assist PointsBet to verify your identity. You can send such documentation to: verification@pointsbet.com.
- All certified documents must be produced in the English language or they will be rejected. PointsBet reserves the right to carry out checks on the individual certifying documents and to get in touch with them to verify the validity of the document. PointsBet may in its discretion reject certified documents for any reason.
- PointsBet may at any time request acceptable photographic identification and proof of an applicant’s and/or a Member’s current address to ensure that all information and ID supplied to PointsBet is up to date. This may require official certification of your ID documents by a permitted Certifier upon our request.
- Should you deliberately falsify any ID or any other details for any purpose associated with applying for an Account or transacting on the Account, PointsBet reserves the right to suspend the Account and/or close the Account without prior notification to you.
- If a Prepaid/Virtual/Electronic/Travel/Debit card is to be used by a Member to fund the Account, legible copies of the front of the applicable card may be requested by PointsBet for its approval. PointsBet reserves the right at its discretion to refuse to accept any such card including but not limited to in circumstances where the card is dishonoured. Cards used to fund a Member’s Account must match the Member’s Account details. Cards with a name other than that which is registered with PointsBet for the Account in question will be refused and the Account may be suspended until proof of consent is provided by the third party cardholder. PointsBet reserves the right to request a copy of the front of the card registered on the Account at any time. Receipt of a card is no guarantee of Account activation/re-activation.
- Members also acknowledge and agree that PointsBet has certain customer enhanced due diligence obligations under the Act, and in respect of those obligations PointsBet may use the third-party services to check for adverse media and conduct source of funds verification (including without limitation ultimate beneficial ownership and company related reports if applicable) activities, credit and other verification checks from time to time to ensure compliance as part of providing the PointsBet services to the Member.
- By applying for and subsequently holding an Account, applicants and/or Members expressly consent to PointsBet proceeding with identity verification and customer enhanced due diligence as described herein this clause 1.4 or otherwise in these terms and conditions or as notified by PointsBet to a Member, and (without limitation): a. consent to collection, use and disclosure of ID in accordance with the PointsBet privacy policy these terms and conditions; b. consent to their personal information being disclosed to third parties (including any credit reporting agency or customer enhanced due diligence related agency); c. consent to their personal information being checked with the document issuer or official record holder via third party systems in connection with the clause 1.4 and otherwise for compliance with the Act; d. consent to their personal information being disclosed to PointsBet’s verification agent(s), which will act as their intermediary, for the purpose of exercising their right, under the Privacy Act 1988 (Cth), to access personal information lawfully held about them by third parties and they consent to those third parties using their personal information for the purpose of monitoring and improving verification services.
- By applying for and opening an Account, and accepting these terms and conditions, Members confirm that (i) they are authorised to provide all the personal information and ID referred to in this clause 1.4, (ii) declare to the best of their knowledge that the information they have provided is true and correct at the date of provision, and (iii) they understand that providing false or misleading information is an offence under the Act.
1.5 ACCOUNT SECURITY
- A Member is responsible for ensuring that their user name and security details (including any personal identification number (‘PIN’), password or Account number) (‘Secure Member Details’) are kept confidential. If a Member suspects that their Secure Member Details may no longer be confidential or that there may have been unauthorised use of their Account, they must notify PointsBet immediately, and PointsBet may provide the Member with new Secure Member Details. Where PointsBet provides the Member with new Secure Member Details, PointsBet reserves the right to invalidate any future transactions which attempt to utilise the previous Secure Member Details of that Member.
- Where a Member wishes for another individual to have access to their Account or any Secure Member Details (including any family member, business or corporate entity or any other person whatsoever), this must first be approved by PointsBet and details for that person provided. PointsBet may refuse such request for access at its discretion. A Member remains solely responsible for their Account including but not limited to transactions, bets and Account changes made by any authorized individual. PointsBet reserves the right to request full certified identification documentation from any proposed nominee.
- Subject to Rule 2.1.7, Members will be responsible for all bets on their Account in which their Secure Member Details are used.
- Members should check the balance of their Account each time they log on to their Account or at the time they place their bet. In the event of a query, it is the Member’s responsibility to notify PointsBet immediately.
- If minors have access to a laptop or computer that a Member uses to log into their Account, PointsBet strongly recommends that a child protection software package is installed onto that equipment.
- PointsBet’s Website contains adult content and is intended for use by persons over the age of 18.
1.6 DEPOSITS AND WITHDRAWALS
- Deposits into an Account can be made by means provided on the website.
- PointsBet reserves the right to remove or add payment options from time to time. Current available payment methods can be viewed within the ‘My Account’ section of our Website when you are logged in to your Account.
- If PointsBet determines that funds deposited are not for the purpose of betting, PointsBet may in its discretion decline the deposit, return the funds to the original payment method used to fund the PointsBet Account, and close the Member’s Account.
- If PointsBet determines that the funds deposited are not from a funding instrument in the Member’s name or are not expressly authorised to be used by them, PointsBet reserves the right to decline the deposit and return the funds to the original payment method. If this determination takes place after bets have been placed, PointsBet reserves the right to void any resulted or pending bets on the Member’s Account.
- If PointsBet determines that there is not enough information to prove the owner of a particular payment option, we reserve the right to request certified documentation as proof of ownership prior to making any decision.
- PointsBet reserves the right to check directly with the Member’s funding institution that supplied the payment option used to deposit to confirm that the details provided by the Member to PointsBet are valid and correct.
- PointsBet requires that any deposits into a Member’s Account be turned over at least once or ‘bet through’ prior to authorising a withdrawal from the Member’s Account. Turnover of deposits can be on any sports or racing market including tote products.
- PointsBet reserves the right to waive Rule 1.6.7 should the Member be restricted in stake while placing a bet, if an error is made during a transaction, or for any other reason, determined at our discretion.
- By depositing to PointsBet you accept that at its discretion, PointsBet may require a Member to return the value of their deposit back to the original funding instrument.
- PointsBet must comply with the Act. Should we consider that a deposit or withdrawal may potentially be fraudulent, we reserve the right to request proof of deposit or withdrawal bank account information to verify that the information provided is true and correct prior to permitting funds to be withdrawn from the Account.
- If PointsBet determines that the risk presented from a payment to or from an Account to be undesirable, PointsBet reserves the right to cancel the deposit or withdrawal.
- Subject to Rule 1.6.13, PointsBet does not charge Members for debit card deposit or withdrawal fees.
- PointsBet reserves the right to pass on any transaction processing fees to Members who we determine to make deposits into their Account for purposes other than betting.
- PointsBet does not allow third party bank account holders or debit card holders to transact on an Account that has not been registered in their name. Member’s must use their own or joint deposit and withdrawal methods. PointsBet reserve the right to suspend any Accounts, without notice, where third party payment details have been used and will request confirmation of permitted use from that third party prior to re-opening the applicable Account and allowing further transactions.
- If PointsBet successfully identifies third party payment transactions on an Account; PointsBet reserves the right to remedy the situation. Members accept that any bets placed, or still pending may be voided and funds returned to them. Members accept that PointsBet will review each situation on a case by case basis taking into account deposits, withdrawals, bets and any other information available. Members accept that when an Account has not been operated on a good faith basis that PointsBet may refuse future transactions and retrospectively void existing ones, at its discretion.
- PointsBet reserves the right to place limits on deposits and restrict or prohibit withdrawals on any Member’s Account if the Member has not fulfilled the ID requirements specified in Rules 1.4.1-1.4.10 (inclusive), including if PointsBet considers it is required suspend a members account entirely until those requirements have been satisfied.
- Where you have successfully opened a supplementary Account with PointsBet (i.e. where one Account already exists in any state), PointsBet will attempt to ensure restrictions will be applied to the new Account. As supplementary Accounts are breaches of PointsBet’s Rules, Members accept that PointsBet detection of this is on a “best efforts” basis and that they are still responsible for transactions on all Accounts held with their details. This includes transferring self-exclusions and deposit limits to duplicate Accounts where known by the Member. Further Members must make PointsBet aware of instances of any duplicate account if known by them.
- PointsBet, at its own discretion, reserves the right to process withdrawals up to (or equal to) the original deposited amount back to a debit card used to deposit by the Member.
- PointsBet reserves the right to reject pending withdrawals to ensure that the maximum loss of all pending bets do not result in a negative account balance.
1.7 CHARGE BACKS
- Members agree and warrant that no charge-backs or other cancellation of deposits will be made relating to your Account without our consent. In the event of any of the foregoing occurring, you agree to indemnify us for any costs, claims, damages and expenses relating to or arising in connection with this, including any expense incurred by us in recovering such amounts.
- If a Member disputes a financial transaction on their Account relating to a third party (e.g. Bank), PointsBet may temporarily suspend your Account, without notice, pending an investigation by us relating to the transaction. If we incur any loss as a result of that investigation, we reserve our right to recover such losses from you.
- If you use any of PointsBet banking specific options, you accept that PointsBet may request a certified or non-certified bank statement to verify where funds have originated from prior to any withdrawal being approved. You also accept that PointsBet may decide to return these funds at its discretion and void bets should it deem the funds may be unauthorised.
1.8 PREVIOUS DSF ACCOUNTS (PRIOR TO FEBRUARY 16TH 2018)
- Any PointsBet member who held a Deferred Settlement Facility account with a negative available balance prior to the National Credit Ban (16th February 2018) will have an “outstanding debt” balance showing in their My Account page. Members with outstanding debt balances will not be able to place any bets with PointsBet until the account is returned to a positive balance.
1.9 FRAUD
- PointsBet reserves the right to withhold deposited funds and/or winnings from resulted bets should we determine that a debit card has been misused or used fraudulently. Any matters of inappropriate or fraudulent use of any card (debit of otherwise) will be reported to the relevant authority. The Member’s Account may also be permanently closed.
- PointsBet may employ third party technologies to track and store technical information on the device that Members choose to use. Members accept that this data may be used to reach decisions on investigations where Accounts have not been operated in good faith, including but not limited to Account takeover, bonus or betting abuse, multiple Account operations, payment method abuse etc.
- PointsBet reserves the right to close the Accounts of, and void any or all bets made by any person, group of people or corporation in an attempt to defraud PointsBet. This includes, but is not limited to, situations where an account is being used by someone other than the account holder.
- PointsBet may periodically review Accounts to monitor any activity that it might consider unusual. In this instance, PointsBet reserves the right to suspend an Account pending a full investigation, without notice.
- You will not knowingly disguise or interfere in any way with the IP address of the computer or internet- enabled device you are using to access the website or otherwise take steps to prevent us from correctly identifying your device or the actual IP address of the computer you are using whilst accessing the Website.
- You shall indemnify and shall be liable to pay us, on demand, all costs, charges or losses sustained, or liabilities incurred by us (including any direct, indirect or consequential losses, any loss of profit and loss of reputation) arising directly or indirectly from your fraudulent, improper, misleading, manipulative or other unacceptable activity (whether or not unlawful).
- We may have reason to suspect that you have been involved in fraudulent, improper, misleading, manipulative or other unacceptable activity (whether or not unlawful) in relation to your access to or use of our Services. Such activity can include (but is not limited to) that you:
a. used or attempted to use any software-assisted methods or techniques or hardware devices for participation or manipulation of any of our systems;
b. have introduced or attempted to introduce any virus or other harmful or malicious application or material to our systems;
c. have introduced or attempted to introduce any defamatory, obscene, abusive or unlawful material to our systems;
d. have abused or misused any bonus offer or promotion offered by us;
- We reserve the right to seek the fullest civil and criminal sanctions against any Customer involved in financial crime and, where we have reasonable grounds for suspicion and without notice to you, to notify the relevant regulatory, sport’s governing body or law enforcement authorities where appropriate.
1.10 POINTSBET’S RIGHTS AND OTHER MATTERS
- PointsBet reserves the right to cancel, change or restrict the products or bet types or deposits or stakes at any time with or without notice to Members.
- In accordance with its NTRWC Licence Conditions, PointsBet maintains a separate bank account which contains sufficient funds to match every dollar of Member funds. This requirement is regularly monitored by the NTRWC to ensure compliance.
- PointsBet has made considerable efforts to ensure that its sports betting business operates in a fair, efficient and accurate manner. To the extent permitted by law, PointsBet excludes all warranties (express or implied) relating to or arising out of the betting services we offer and excludes any liability for direct, indirect or consequential loss, damage, expense or injury suffered by any Member arising out of:
a. the Rules;
b. use by a Member of their Account; or
c. any action taken by PointsBet in relation to a Member’s Account.
- Nothing in these Rules affects our liability:
a. to pay any Member winnings or other amounts properly owing to such Member pursuant to these Rules;
b. for death or personal injury arising from our negligence;
c. for our fraudulent misrepresentation; or
d. for any matter in respect of which our liability cannot be excluded or limited under applicable law
- Subject to Rule 1.10.3 and 1.10.4, and to the extent permitted by law, PointsBet’s liability in respect of any claim or loss shall be limited in amount to the relevant bet placed by a Member.
- A Member may only have one Account. If a Member has additional Account(s), then the Account balances of all associated Accounts shall be transferred into the first Account opened by the Member (‘First Account’.) Further:
a. if, after such transfers the First Account has a debit balance, then PointsBet shall be entitled to receive payment immediately upon written request to the Member to clear the debit balance; or
b. if, after such transfers there is a credit balance in the First Account, the credit balance will be held by PointsBet until such time as a determination has been made by PointsBet as to whether or not there has been a breach of these Rules.
- PointsBet reserves the right to remove bonuses and refund the remaining balance should a Member be in breach of these Rules and/or the terms and conditions of the specific promotion. The terms of our promotions can be read at Section 4 of our Terms and Conditions.
- PointsBet products and bet types are intended for bona fide Members, that is, those Members who act in good faith, sincerely, without fraud, and who place a bet with PointsBet for the purpose of recreation and entertainment.
- PointsBet reserves the right, in its sole discretion, to determine that a Member is not eligible for certain products, bet types or promotions.
- PointsBet reserves the right to close or suspend the Accounts of, and void any or all bets made by any person where, in PointsBet's reasonable opinion, the Account has not been operated with integrity and/or the bet has not been placed on a good faith basis. This includes, but is not limited to, situations where an account is being used by someone other than the account holder. PointsBet can, in its sole discretion, withhold any or all related funds in the Account pending the outcome of an investigation on that Account.
- Where a Member has been referred to PointsBet by a third party including by a third party operated website and where that third party is an affiliate or agent of PointsBet, you acknowledge that PointsBet may make commission payments to that third party. Payments to agents or affiliates are unrelated to the odds or prize money offered to Members by PointsBet.
- As a responsible bookmaker PointsBet offers its Member’s the ability to control the amount they deposit by setting a limit on the amount they can deposit to their Account per day, week or month (referred to as a deposit limit).
- Separate and distinct from any deposit limits that customers may choose to set, PointsBet (using its sole discretion) may impose its own risk or liability caps on deposits into betting accounts and this includes (without limitation) risk or liability caps on the amount that may be deposited into a betting account customers in a given period such as, for example, 24 hours or 7 days or 30 days.
- Any reference to a discretion which may be exercised by PointsBet under these Rules means PointsBet’s sole and absolute discretion.
1.11 RESPONSIBLE GAMBLING
- PointsBet:
a. makes every reasonable effort to prevent self-excluded customers from returning and using our service;
b. provides pre-commitment facilities to help you control your spend (you can access these via the “My Account” section of our Website); and
c. provides a self-exclusion facility to help you if you feel that you have developed a gambling problem. At your request, we will prevent you from using your Account indefinitely. To this end, we may retain such personal information as is necessary (and for as long as is necessary) to implement the self-exclusion facility as effectively as possible, including the following information: your name, address and payment details. For information on problem gambling generally, please refer to Section 7 (Responsible Gambling) of our Terms and Conditions.
- If you are a self-excluded customer:
a. you must not attempt to open an Account or place any bets with us (using your Account or otherwise);
b. you are fully liable for your actions, and for all activity and bets placed on your Account; and
c. subject to these Rules, if PointsBet considers that you have deliberately circumvented our controls (e.g. by opening a duplicate Account) and placed bets while you are self-excluded: (i) open/pending bets will be voided and the original stake and withheld amount will be returned to your Account; (ii) resulted bets will stand; and (iii) the balance of your Account (minus any credit owed from previous DSF Accounts (prior to 16th February 2018) will be returned to you.
- PointsBet marketing and communications are aimed at over 18’s only. PointsBet does not market to individuals for whom gambling has become a problem.
1.12 INFORMATION PROVIDED TO GOVERNING BODIES
- PointsBet reserves the right to provide an Australian governing sporting body (defined below), with:
a. records or documents in the possession or control of PointsBet relating to betting transactions of the Member; and
b. the name, contact details and similar identifying information in the possession or control of PointsBet relating to that Member.
Such information will only be provided to assist in a legitimate inquiry conducted by an Australian governing sporting body to maintain the integrity of the sport. For the avoidance of doubt, the Member consents to PointsBet providing the above information to an Australian governing sporting body.
- For the purposes of this Rule, ‘Australian governing sporting body’ is an Australian sports organisation that has a regulatory or sanctioning function and includes each of the Australian State and Territory Thoroughbred Racing, the Australian Football League, Athletics Australia, the Australian Rugby Union, Cricket Australia, Football Federation Australia, the National Basketball League, the National Rugby League, Swimming Australia and Tennis Australia.
1.13 DISPUTE RESOLUTION
- These Rules shall be governed by and construed in accordance with the laws of the NT and subject to Rule 1.12.3 each Member irrevocably submits to the non-exclusive jurisdiction of the NT Courts in respect of any dispute arising out of or relating to these Rules or the provision by PointsBet of goods or services to Members (‘Dispute’).
- As a first point of reference, you should direct your dispute to the Customer Service team by emailing support@pointsbet.com.
- If any Dispute cannot be resolved between PointsBet and the Member, the Dispute must be referred to a representative of the NTRWC via the online ‘gambling dispute form’ found at https://nt.gov.au/industry/gambling/gambling/complain-about-a-bookmaker-or-betting-exchange-operator for final determination. A Dispute must be lodged with the NTRWC within 14 days of the Dispute arising. The decision of the NTRWC is final and binding on PointsBet and the Member. Nothing in this Rule precludes a party from seeking urgent interlocutory relief from a Court if such relief is reasonably required.
- We reserve the right to close any pending Bet or alleged pending Bet that is the subject of a dispute by you as to any material term of the Bet in order to minimise the financial consequences of the Bet pending the resolution of the dispute and any such closure will be valid and effective as though made with your agreement.
- Any complaint or queries regarding missing Bets should, if possible, be supported by a copy of the ‘bet confirmation’ print out (if available) together with full details of the missing Bet.
- No rule of contract interpretation may be applied in the interpretation of these Rules to the disadvantage of a party on the basis that it prepared or put forward these Rules or any document forming part of these Rules.
- PointsBet is committed to providing world-class Customer Service, and to dealing with disputes and complaints in a prompt, efficient, and fair manner. We will endeavour to provide our final response to your dispute or complaint within 21 days, unless the dispute has been escalated to the respective wagering jurisdiction as per Rule 1.13.3. We may require additional information from you about your dispute or complaint. If this applies, we will contact you.
1.14 INACTIVE ACCOUNTS
- Your Account will become inactive if you have not made a deposit or placed a bet on your Account for a period of more than 18 months (‘Inactive Account’). To keep an Inactive Account open you must pay a fee of $10 per month (‘Administration Cost’) which will be deducted from your Inactive Account (unless your Account balance is $0). To avoid the Administration Cost, you can simply either place a bet or withdraw your funds into your bank account. If this occurs your Account will no longer be deemed an Inactive Account.
1.15 COMMUNICATION
- Any bet must be made by you via the betting platform on our website. Other offers to do these things, including requests sent by fax or email or text message and we will not be liable for any loss caused by delay in our accepting such an offer.
- By providing us with a postal and/or email address and/or telephone number at which to contact you, you warrant that we will at all times be able to contact you promptly at the address and/or number in question. If any of these contact details become obsolete or ineffective, you must notify us immediately and provide us with an effective alternative.
- A communication that has been sent or made available to you will for all purposes be deemed to have been received by you.
- We will not be held responsible for correspondence sent to you/messages left for you at a previous postal address, email address or telephone number, if the correspondence was sent to/ message left at the address or number we have for you on record, and you have not notified us in writing of any changes to that address or number. It is your responsibility to notify us of any significant time that may be spent away from your normal contact points, whether overseas or not. Alternative contact details must be provided. The address you provide us with at any given time should be (a) your primary home address, (b) current, (c) accurate. If you move abroad, you must tell us immediately.
1.16 RISK
- Spread betting is a form of gambling where you can lose more than you initially Bet or deposit. This means spread betting will not be suitable for everyone nor suit everyone’s financial situation. Ensure that you are aware and fully understand the risks associated with spread betting before placing a bet. Please remember you bet with us entirely at your own risk. Please therefore remember to bet responsibly.
1.17 EVENTS OF DEFAULT
Each of the following are Events of Default:
- Any payment has become due to us from you and remains unpaid on the expiry of the time allowed for payment by these Rules;
- Your failure to perform any material obligation due to us including a breach of these Rules;
- Any statement, made by you to us, is false, inaccurate or misleading in any material way;
- Any statement previously made by you to us becomes false, inaccurate or misleading in any material way; and you fail to inform us of the true position as soon as you reasonably can;
- Your death;
- A statutory demand is served upon you or bankruptcy proceedings are initiated against you or we have reasonable grounds to believe that you are unable to pay your debts as they fall due (if you are an individual), winding-up proceedings, or if you enter into a voluntary arrangement with your creditors or analogous procedure is commenced against you;
- Any payment by you, including payment by cheque, is dishonoured or other payment instruction given by you is returned unpaid (unless resulting from our or a third party’s error or fault or some other cause beyond your reasonable control) and you do not make a full payment to us with the time allowed for payment;
- freezing order is validly served on us by a third party in relation to you;
- It is discovered that you are being medically treated for a form of mental illness which affects your capacity to enter into a Bet with us and makes it inappropriate for you to be spread betting. Mental illness which we consider Events of Default, include but are not limited to dementia, Alzheimer’s and clinical depression;
- When dealing with our staff you behave in a way that we reasonably believe is threatening or abusive;
- You are or we have reason to believe that you are located permanently in a jurisdiction where spread betting is prohibited, including the United States;
- You move abroad and do not inform us of this fact prior to placing a Bet with us.
- You have directly/indirectly allowed someone under the age of 18 years old to trade on your account;
- An Event of Default has occurred and you do not draw it to our attention; or
- Any event occurs that is described elsewhere in these Rules as an Event of Default.
1.18 CONSEQUENCES OF AN EVENT OF DEFAULT
- If an Event of Default occurs, we shall be immediately entitled but not obliged, to close all or any of your open Bets whether they are in loss or in profit, at our then prevailing market price, or if there is none, at a price that is fair and reasonable. If there is an Event of Default our right to close all or any of your Bets that are open at that time will apply for as long as long as those Bets remain open.
- If an Event of Default has not occurred but we reasonably believe that it is likely to occur we shall be immediately entitled to close all or any of your open Bets whether they are in loss or in profit, at our then prevailing market price, or if there is none, at a price that is fair and reasonable.
- We will not be under any obligation to give you any opportunity to remedy an Event of Default before we close your Bets. If, however, we do choose to do so, this in itself will not waive the Event of Default or our rights in relation to it.
1.19 DEATH OF A CLIENT
- On receipt of a certified copy of a Death Certificate or other news of a client’s death that we in good faith believe to be true, we will within a reasonable time close all positions on the deceased’s account at our prevailing price, or if none at a price that is fair and reasonable.
- Payment will be issued for any credit balance (payable to personal representatives of the deceased) or demand made on the estate for payment of any debit balance.
1.20 MAINTENANCE
- It may be necessary from time to time to suspend one or more of our online betting platforms in order to carry out upgrades, repairs and maintenance. We shall endeavour to give you prior notice of any such occurrences, but this may not always be reasonably practicable.
1.21 TECHNOLOGICAL FAILURE AND EXCLUSION OF LIABILITY
- We will not in any event be responsible or liable for any loss, loss of profit, revenue, business, contract, goodwill or data or any consequential loss or damage (being loss or damage arising from our breach of these Rules that we could not have reasonably been expected to foresee when we entered into these Rules with you) arising from the use or unavailability of our Services. Such loss and damage may result from (including but not limited to):
- the unavailability whether for technical reasons or otherwise of any one or more of our betting platforms and/or software and/ or Website so that you are unable to communicate or trade with us (including without limitation because, for example, all our telephone lines are busy or through the loss of internet communication); or
- an inaccuracy or mistake in any information given to you or in carrying out your instructions; or
- the closure or avoidance of any Bet in accordance with these Rules); or
- as a result of any referral to our online Bet referral team under paragraph 3.3.4 below; or
- as a result of the unauthorised access to our Services by a third party or the corruption of data sent by you to us or by us to you.
- We take reasonable precautions to ensure that data generated and used by us has been swept for viruses, but it is your responsibility to ensure that the transmission, opening or use of such data to you will not adversely affect your systems or data. You should ensure that your computer has up to date virus and malware detection software and that you carry out such virus and other checks as you consider appropriate. No responsibility is accepted by us for losses that you may suffer as a result of viruses on your device which includes but is not limited to infection with malware, Trojan virus and keylogging software.
- If and to the extent that we are found liable for any losses or damages, whether arising from or in connection with a Bet otherwise, the maximum amount of our liability will be limited to the average stake of the member on markets with equivalent spread levels multiplied by four times the ‘Spread Level’. Spread level is defined as the price of the over side of a market minus the under side of a market or the difference in team lines (plus and minus options) for specific markets.
- Each provision of this paragraph operates separately. If any provision is disallowed or found to be ineffective by any Court or regulatory body the other provisions will continue to apply.
1.22 LIMITATION ON WINNINGS
- PointsBet reserves the right to limit the total winnings payable to any Member (client) for an individual bet to one million dollars ($1,000,000.00) (the “Maximum Win Limit”). The Maximum Win Limit applies regardless of your stake. To avoid doubt, the Maximum Win Limit does not impact PointsBet’s right to refuse any bet, or part of a bet, or impose limits on a Member’s Account in accordance with these Terms and Conditions (for example, refer to Rule 3), nor does it impact PointsBet’s right to rely on and enforce these Terms and Conditions.
1.23 MARKET INFORMATION
- As a matter of business practice we endeavour to keep you informed, whether through the internet, Website, telephonically, through text services, promotional materials or otherwise, of the status from time to time of certain sporting events around which we are making Markets, and, on occasion, of without limitation (i) current statistics related to a sporting event (including without limitation, indicative scoring information for live in-play markets) or (ii) prior historical statistics relevant to such events or markets. While we offer such information in good faith, we do so without any responsibility and make no claim as to the accuracy or otherwise of any such information. You are warned that any information given to you by us may be inaccurate and you promise that in making decisions that relate to your Bet(s) you will rely solely on your own information (obtained from sources other than us) and judgement.
1.24 FORCE MAJEURE EVENTS
- We may, in our reasonable opinion, determine that an emergency or an exceptional market condition exists (a “Force Majeure Event”), in which case we will, as soon as is reasonably practicable take reasonable steps to inform you of this by email, if you have provided us with an email address, and by post or telephone, if not.
- A Force Majeure Event shall include, but is not limited to, the following:
a. any act, event or occurrence (including, without limitation, any strike, riot or civil commotion, interruption of power supply, electronic, communication equipment or supplier failure) which prevents us from offering or continuing to offer one or more of our Markets at all or in a manner that we reasonably consider to be a fair betting market;
b. The suspension, closure, abandonment or failure of any event upon which we base, or to which we in any way relate, our Markets, or the imposition of limits or special or unusual terms on the betting in any such Market or on any such event, which prevents us from offering or continuing to offer one or more of our Markets at all or in a manner that we reasonably consider to be fair betting market; or
c. the occurrence of an excessive movement in the level of any of our prices and/ or any corresponding Market or our anticipation (acting reasonably) of the occurrence of such a movement prevents us from offering or continuing to offer one or more of our Markets at all or in a manner that we reasonably consider to be a fair betting market.
- If a Force Majeure Event has occurred, we may at our discretion and without notice to you, take steps to the extent that our actions are necessary or reasonable by way of obviating or reducing the commercial risks stemming from the Force Majeure Event.
2. BETTING ACCOUNT RULES
2.1 WITHHELD AMOUNT
- When a Member places a sports spread bet, PointsBet will allocate an amount of funds in the member’s player account to that bet (“withheld amount”). The withheld amount will be equal to the Member’s stake in relation to that bet plus an amount, determined by PointsBet, to take into account the Member’s expected exposure in relation to that bet. Members must have enough available funds in their player account to cover the withheld amount before the bet will be accepted.
- The withheld amount will not be available for use by the Member in relation to any other bet.
- Members acknowledge that the amount lost in relation to the bet may be more than the withheld amount, up to the applicable ‘Stop Level’ (refer to Section 2.4 below) multiplied by the Member’s stake.
- The withheld amount will be displayed to Members on the PointsBet website (via client bet slip) prior to the Member confirming the placement of their bet.
- A Member will not be permitted to place a bet if they do not have the available balance in their player account to cover the withheld amount for that bet, regardless of the position of any open bets of the Member that are yet to result.
- Where the resulting of a Bet results in a loss to you, the cash sum lost will be debited from the amount withheld from that bet at time of bet placement. If the amount lost is more than the amount withheld it will be taken from the available balance of your account. If your cash account goes into negative available balance as a result of a bet resulting and you have no pending bets, PointsBet will return your available balance to zero via a manual credit to your account.
- If your cash account goes into negative available balance as a result of a bet resulting and you have no pending bets, PointsBet will return your available balance to zero immediately via an automatic credit to your account.
- If your account goes into negative available balance as a result of a bet resulting and you have a pending bet, PointsBet will automatically attempt to take withheld amount from any unsettled bets in order to cover the negative available balance. If your available balance is still negative after this events, PointsBet will return your available balance to 0 immediately via an automatic credit to your account.
- PointsBet at its sole desertion reserves the right to recalculate and adjust withheld amounts at any time.
- PointsBet at its sole desertion reserves the right to cancel or reduce the stake of any wager that has been accepted in error and the client does not hold sufficient balance to cover required withheld amounts
- PointsBet reserves the right to void pending bets prior to the start of their respective events to the extent necessary to ensure that the maximum loss of all pending bets do not result in a negative account balance.
- PointsBet reserves the right to reverse any Zeroing transactions on client accounts where voiding or resettlement of any pending bets at the time of the zeroing transaction eliminate the requirement to zero the account balance at that time of the initial Zeroing transaction being reversed.
2.2 MARKET MULTIPLIER LEVELS
- All betting markets offered by PointsBet are subject to maximum win/loss multiplier levels. These levels vary from market to market.
- The multiplier level for a betting market represents the maximum level to which a bet can win or lose by (i.e. the difference between the market value at time of bet placement and the closing result of that bet.
- If the difference between the market value at time of bet placement of a Member’s bet and the closing result of that bet is greater than the max multiplier level, the multiplier level will be applied in order to calculate the Member’s wins/losses from that bet.
Example: A Member bets $10 on “over 200 points” in a basketball game. The max multiplier level for this betting market is set at 50, meaning that the most the Member can win or lose on this bet is $500 (max multiplier level x stake). The game finishes with 260 points. Accordingly, the Member wins $500 (i.e. applying the max multiplier level of 50, rather than applying the 60 points difference between the opening and closing levels of the bet). Similarly, if the game finishes with 140 points, the Member loses $500 (i.e. applying the max multiplier level of 50, rather than applying the 60 points difference between the opening and closing levels of the bet).
- The applicable multiplier level for each market is displayed in the “info” section of each market as well as in the bet slip that appears when a client makes a selection.
- Max Multipliers are designed to limit the Members exposure to both losses and profits by automatically attaching a max win or loss limit at time of bet placement.
- Members acknowledge that it is their responsibility to make themselves aware of the betting limit applicable to their bet before placing it.
2.3 CLIENT STOP LOSS LEVELS
- In certain betting markets, a member can elect to reduce their max multiplier level by placing a ‘stop loss’ on their bet. The level to which the multiplier level can be reduced varies by market to market.
- When a member elects to place a “stop loss” on a bet for a particular market, this limits their exposure to both losses and profits.
- The “Max win” and “max Loss” amounts are shown on the bet slip before a Member places his bet.
- Members acknowledge that it is their responsibility to make themselves aware of the Stop Loss they have applied to each bet before placing it.
2.4 BET PERIOD
- A bet is regarded as a “pending bet” from the time a betting receipt number has been issued for that bet until the earlier of:
a. the conclusion of the sporting event dictating the outcome to which the bet relates (market resulting);
b. PointsBet exercising any right to close or void a bet as set out in these Rules.
2.5 DETERMINING WINS/LOSSES FROM BETS
- Upon the resulting of a Member’s bet, the Member must pay PointsBet the difference between the market value at time of bet placement and the closing result (final result) multiplied by the amount of the bet (the “stake”) if the bet is:
a. an “unders” bet and the closing result of the bet is higher than the market value at bet placement; or
b. an “overs” bet and the closing result of the bet is lower than the market value at bet placement
c. for line betting examples (“plus” and “minus”) – see examples below
- The closing level of the bet will be determined by reference to:
a. the final outcome to which the bet relates as at the conclusion of the relevant sporting event;
Example 1 : PointsBet offers a basketball betting market in relation to a basketball game with betting options of under 200 points/over 202 points. A Member places a $10 bet on under 200 points. The final result is 205 points scored by both teams. The Member owes PointsBet 5 multiplied by their stake ($10) – i.e. $50.
Example 2 : PointsBet offers a line market in relation to an AFL match with betting options of MINUS 5 points – Adelaide/PLUS 3 points - Brisbane. A member places a $10 bet on Plus 3 points - Brisbane market. The final result is an 8-point loss to Brisbane (8-point win to Adelaide). The member owes PointsBet 5 multiplied by their stake ($10) – i.e. $50. Alternatively, if the final result was a 1-point win to Brisbane, PointsBet would owe the member 4 multiplied by their stake ($10) – i.e. $40
Example 3 : In the above market, if a member places a bet on Minus 5 points – Adelaide, and Adelaide win by 2 points (a 2 points loss to Brisbane), the member owes PointsBet 3 multiplied by their stake ($10) – i.e. $30.
- Upon the closing of a Member’s bet, PointsBet must pay the Member the difference between the opening level of the bet and the closing level of the bet multiplied by the stake if the bet is:
a. an “unders” bet and the closing level of the bet is lower than the opening level of the bet; or
b. an “overs” bet and the closing level of the bet is higher than the opening level of the bet.
c. for line betting examples (“plus” and “minus”) – see examples below
- The closing level of the bet will be determined by reference to:
- the final outcome to which the bet relates as at the conclusion of the relevant sporting event;
Example 1 : PointsBet offers a basketball betting market with betting options of under 200 points / over 202 points. A Member places a $10 bet on over 202 points. The final result is 205 points scored by both teams. PointsBet owes the member 3 multiplied by their stake ($10) – i.e. $30.
Example 2 : PointsBet offers a line market in relation to an AFL match with betting options of MINUS 5 points – Adelaide/PLUS 3 points - Brisbane). A member places a $10 bet on Minus 5 points - Adelaide market. The final result is an 8-point win to Adelaide (8-point loss to Brisbane). PointsBet owes the member 3 multiplied by their stake ($10) – i.e. $30. Alternatively, if the result was a 4-point win to Adelaide, the Member owes PointsBet 1 multiplied by their stake – i.e. $10.
Example 3 : In the above market, if a member places a bet on Plus 3 Points – Brisbane and Brisbane win by 4 points (a 4 points loss to Adelaide), the PointsBet owes the member 7 multiplied by their stake ($10) – i.e. $70.
2.6 STATEMENTS AND BET REVIEWS
- You are able to access your current statements and previous statements online through our Website.
- Depending on the type of account you operate, you will receive a weekly email at 11:59pm Sunday that provides a link to our Website where you can view all Bets you have made and other account activity up to an including the preceding Monday. This practice may be varied at any time in the future. If we do amend how you are to receive statements, we will notify you of any changes made.
- You should notify us immediately if your statement is inaccurate or if you have any queries concerning the contents. If a statement contains an error or is otherwise inaccurate, that error will not affect the validity of the relevant Bet or the betting instruction.
- All your opening and closing Bets can be viewed by clicking on Betting Statement within ‘My Account.’ We strongly recommend that you keep your own records of your Bets including details of the times, dates, stake, market and all other relevant details of your Bets.
3. GENERAL BETTING RULES
3.1 SPREAD BETTING MARKET PRICES (GENERAL)
- PointsBet will offer a “over” and “under” option for most markets or a “plus” and “minus” option for line betting markets. The difference between the over/plus and under/minus option will be the “Spread.”
- A Bet must be made for a specified amount per point of movement in the relevant Market; this is your stake.
- When you place an “overs” Bet, the opening level will be the higher price quoted by us for the relevant market.
- When you place a “unders” Bet, the opening level will be the lower price quoted by us for the relevant market
- When you place a “minus bet” the opening level will be the price quoted by us with a “negative” symbol attached to indicate this is a “minus” bet
- When you place a “plus bet” the opening level will be the price quoted by us with a “positive” symbol attached to indicate this is a “plus” bet
- When you are betting via one of our online betting platforms, prices are not offers by us to enter into a Bet with you at the stated price. They are indicative only and due to technological limitations (for example, internet data transfer protocols) may not be the most up-to-date price.
- A Bet will only be placed when your offer has been (a) actually received and (b) expressly accepted by us. In all cases when a Bet is accepted by us we shall generate an internal Bet reference number.
- We do not guarantee the size of the Spread at any time, or that it will remain the same during the life of a Bet.
3.2 PLACEMENT AND ACCEPTING OF ALL BETS
- All bets on an Account are considered to be placed and received in the Northern Territory, Australia.
- PointsBet does not represent or warrant that any bet by a Member on their Account or the acceptance of any bet on an Account by PointsBet complies with the legal requirements of any state or country other than Northern Territory. Members must satisfy themselves (and assume full responsibility for) the legality of:
a. applying to PointsBet for an Account;
b. remitting funds by debit card or other permitted means to an Account;
c. placing bets with PointsBet; and
d. receiving winnings from PointsBet.
- PointsBet reserves the right at any time to refuse any bet or part of a bet without providing a reason or advance notification. The circumstances in which we may refuse a Member’s bet include but are not limited to:
a. a Member is or may be less than 18 years of age;
b. a Member is or may be betting on behalf of a person who is less than 18 years of age;
c. a Member is or may be in breach of these Rules;
d. a Member is or may be in breach of any applicable law; or
e. a Member’s proposed bet would present an unacceptable liability risk to our business. Whether there is an unacceptable liability risk to us for the purpose of this Rule is at PointsBet’s discretion.
- PointsBet reserves the right to close and/or impose limits on a Member’s Account (including limits on any PointsBet products that a Member may wish to bet on but not for the purpose of avoiding the operation of the NSW bet requirements) and refund the balance of their Account, without providing reasons. In this event, we will honour any outstanding bets made pursuant to the Account, unless the Member’s Account has been used for any fraudulent transaction or purpose, in which case any such bets will be void.
- Bets will only be accepted during the betting hours for the Market in which you are betting. These betting hours are subject to change and vary according to the Market that you are betting in. Before opening a Bet, you should ensure that you are familiar with the betting hours for the Market that you wish to trade in. Before placing a Bet, you should also ensure that you are familiar with the restricted betting times that apply during the betting hours for the Market that you wish to trade in, as restrictions on betting times may apply, and these restrictions will impact upon your ability to place a Bet. This information is whenever practicable provided on our Website in the description of the relevant Market. Should you have any queries regarding betting hours or the restricted betting times that apply within betting hours you should telephone us for information or clarification before you place a Bet.
3.3 PLACEMENT AND ACCEPTING OF ALL BETS (EXCLUDING LIVE BETTING) - ONLINE BETTING ONLY
- When a Member is making a bet on their Account via the Internet, it is accepted once the Member submits the bet and a ‘betting receipt number’ is issued through the PointsBet Website. The Member may view this confirmation in the “pending bets” area of “My Account.”
- The generation of the betting receipt number is solely determinative as to whether a Bet has been accepted by us. We reserve the right in our absolute discretion to: (a) refuse to accept any opening Bet on any ground whatsoever and/or (b) restrict the size and price of any opening Bet you wish to place with us.
- You should notify Customer Services as soon as reasonably practicable if you cannot locate a Bet reference number for your Bet or if you dispute any information contained within a Bet confirmation message or should you not receive such a message within two minutes of your Bet having been placed.
- The minimum stakes on a bet on the Internet on an Account is $1
3.4 BET REFERRAL (ONLINE TRADING ONLY)
- Your offer to place a Bet at a price we have quoted to you may be referred for our review. In the event that a Bet is so referred, the following applies: Your bet will go into processing mode with a yellow message displayed at the top of your screen.
3.5 ‘ACCEPTED’ – SPREAD BETTING
- If your Bet is accepted, you will be sent a ‘bet confirmed’ message that will be displayed in green at the top of your screen. This will be displayed for around two seconds after which point the bet details will be visible in your pending bets page.
3.6 ‘PARTIALLY ACCEPTED’ – SPREAD BETTING
- If your Bet has not been accepted in the first instance, PointsBet reserve the right to accept your bet at an equal or lower stake, as long as the price has remained the same and the event relating to the bet has not started.
3.7 ‘RE-OFFERED’ (ONLINE TRADING ONLY)
- If your Bet has not been accepted in the first instance, you will be sent a ‘re-offer’ message inviting you to accept the bet at an updated price and/or stake quoted. Please note that this price and/or stake may be different from the original price quoted to you.
- Given that our re-offer message can vary the stake or price offered back to you, it is important that you check the details carefully.
- It is for you to decide whether to accept our re-offer or cancel at the re-quoted price and/or stake.
- You have 30 seconds to re-offer at the re-quoted price and/or stake before it times out. Failure to respond within the allocated 30 seconds will result in your re-offer being automatically declined.
- The “Re-offer” does not automatically constitute an accepted bet. At any time during the 30 second window of the ”re-offer”, odds may change and PointsBet reserve the right to not accept a re-offer at their sole discretion.
- If your re-offer is received and accepted by us a Bet receipt number will be generated for that Bet and a Bet confirmation message will be displayed on the screen.
3.8 ‘DECLINED’ (ONLINE TRADING ONLY)
- We may decline your re-offer to open a Bet at a price we have quoted to you in our sole discretion as we see fit. This will be displayed to you at the top of your screen as soon as it is declined along with a reason for why it was declined.
3.9 ERRORS
- PointsBet makes every effort to ensure that no errors are made in prices offered on the PointsBet website or bets accepted on an Account. However, we reserve the right to correct any obvious errors and to void any bets where such has occurred. Should this occur, PointsBet will endeavour to contact the Member by email or telephone.
- If the Website erroneously allows a Member to place a bet after a sports or racing event has commenced or been completed, the Member agrees that PointsBet may retrospectively void the bet and demand repayment where any winnings from the void bet have been withdrawn from the Member’s Account. In such an instance, a Member agrees that PointsBet is entitled to issue the Member with an invoice in respect of the amount of the winnings paid in error, and that the invoice shall be evidence that the amount is immediately due and payable. PointsBet may request documents from a Member to assist in investigating such errors.
- If a Member has been paid winnings in error, the Member agrees that PointsBet will notify the Member about the winnings paid in error. When the error is rectified and results in a Members available balance being negative (due to Member re-investing or withdrawing winnings paid in error), the amount required to return the available balance to zero is immediately due and payable, subject to Rule 3.9.4 below.
- PointsBet reserves the right to cancel, or recalculate a bet made by a Member at any time without notice where a Member has received funds in error and invested those funds on a bet or multiple bets for an event or multiple events yet to commence. In circumstances where a Member has invested an amount of money on a bet that is greater than the total amount of money owing to PointsBet for an event or multiple events yet to commence, PointsBet will contact the Member by telephone and/or email to mutually agree the recalculation value and/or bet cancellation arrangements prior to the event(s) commencing. If PointsBet cannot contact the Member prior to the commencement of the event(s), PointsBet may at its discretion let the bet stand, or cancel the bet and/or recalculate the stake investment of a bet or multiple bets to recover funds paid in error.
3.10 Placement and accepting of bets via telephone including in-play
- When you are making a bet on your Account via the telephone, you are responsible for providing the correct Account details. When a bet is made by you via the telephone, it will be repeated to you. A bet is accepted when you either indicate agreement with a bet after it has been read-back to you or, when speaking with a PointsBet representative, if you do not disagree with the bet details, when read-back to you before the telephone call ends. Once a bet confirmed by you, you cannot change or revoke it. PointsBet may, using its discretion, refuse to accept a confirmed bet and a confirmed bet is only considered accepted when the telephone operator confirms that the bet has been successfully placed.
- In the event a telephone call is interrupted for any reason (including a mobile phone dropping out) prior to the confirmation and acceptance of the bet, means PointsBet will deem this bet not have been struck. In such circumstances, it is your responsibility to contact us to confirm the status of the bet.
- PointsBet shall make a voice recording of all telephone calls with you when you are placing a bet, making a complaint or making a query regarding your Account. You agree to such recordings being made. Where a 'Dispute' (defined in Rule 1.13) occurs which cannot be resolved between you and PointsBet, you agree that the recording(s) and/or any records of your transactions via the Internet may be made available to the adjudicator of the Dispute to enable the Dispute to be determined in accordance with these Rules. All records of voice recordings will be securely retained by us in accordance with our privacy obligations for regulatory purposes.
- You are unable to change or cancel a bet once the bet has been accepted by PointsBet unless you can demonstrate to PointsBet's satisfaction that the initial bet was made in error; in which case PointsBet may, at its discretion, void the initial bet and/or allow the customer to replace it with another bet.
- The minimum stake for a bet via the telephone is $10 per bet.
In-Play Betting
- 'In Play’ in these Rules refers to a form of betting whereby the person placing the bet is able to place bets after an event has begun (e.g. betting on the outcome of an AFL football match at half time). In compliance with the Interactive Gambling Act 2001 (Cth), we do not accept live betting over the Internet but may accept live betting via the telephone.
- Any live betting offered by PointsBet will be displayed on the Website and you can call our live betting service to place a live bet on any markets offered. All live betting markets are subject to their respective pre-match rules. While reasonable effort is made to ensure the accuracy of live scores and the status of games displayed on our Website in connection with live betting, we accept no liability for the incorrect display of this information.
- The Live bet process will then follow the same process as set out in Section 3.10 Placement and Accepting of Bets via Telephone (including In-Play) .
3.11 CASH OUT
- PointsBet may, in its absolute discretion, offer the ‘Cash Out’ feature for selected products or bet types. By entering into a bet, you acknowledge that:
a. you may not be able to Cash Out your bet at any particular time, or at all; and
b. PointsBet may deny your request to Cash Out your bet for any reason whatsoever.
- Any Request to Cash Out may not be recalled or cancelled.
- PointsBet may choose to accept or deny your Request to Cash Out in its absolute discretion and without providing a reason or advance notification.
- If PointsBet accepts your Request**,** your original bet will immediately come to an end (will be 'Cashed Out'). The acceptance of a Cash Out request is an agreement to end the original bet early and does not represent a new bet.
- PointsBet will be deemed to have accepted your Request:
a. if you have made the request via the Internet, once the bet is marked as "Cashed Out" in the Settled Bets section of your account; or
b. if you have made the request via the telephone, once you indicate your agreement with the confirmation of PointsBet's acceptance of your Request as read back to you by the PointsBet representative.
- Once You have Cashed Out your bet it is final and you may not reverse it.
- The Cash Out feature is not available on bets where a Bonus Bet has been used.
- The Cash Out feature cannot be used in conjunction with any other promotions or specials. No refunds or payouts will be redeemable or creditable on a Cashed Out bet.
- All Requests are considered to be placed and received in the NT, Australia. PointsBet does not represent or warrant that any Request made by you on your Account or the acceptance by PointsBet of a Request complies with the legal requirements of any state or country other than the NT. You must satisfy yourself of (and assume full responsibility for) the legality of making a Request.
- PointsBet may decline your Cash Out request, void the original bet which was Cashed Out, or demand repayment of any amount paid by PointsBet in respect of the original bet if:
a. The original bet or your Cash Out request was made after the relevant event's completion or result was known; and/or
b. PointsBet suspects fraud or other improprieties in respect of the original bet or your Cash Out request.
- PointsBet is not liable for any loss you may incur in connection with your use of the Cash Out feature or PointsBet accepting or denying your Request (including any loss incurred due to a delay in PointsBet accepting or denying your Request).
- PointsBet may, in its absolute discretion, change, suspend, restrict or cease to offer the Cash Out feature at any time and without providing a reason or advance notification, even where the Cash Out feature has previously been advertised to you as being available at a particular time or in connection with a particular event. PointsBet is not liable for any losses incurred by you in connection with such an action being taken.
3.12 MULTI/ALL UP BETTING
- Multi/All Up Bets are a combination of numerous single bets which multiply the individual odds creating the total dividend. PointsBet accepts multis from 2-12 legs including a combination of Racing and Sports.
- All multi payouts are subject to the PointsBet “Betting Limits” (see 7.13 for more details).
- Multis cannot be placed on dependent or correlated events (other than for a Same Game Multi). PointsBet reserves the right to void and refund a bet at its discretion if legs are related in a multi.
- Winning multis are paid on the product of selections. For example, a winning bet for Selection 1 at $4 and Selection 2 at $5 results in a final dividend of $20 ($4 X $5).
- In the event of an abandoned event or scratched selection, all bets will stand with the abandoned or scratched leg excluded from the multi. However if one or more legs of a Same Game Multi is voided, the Same game Multi will be cancelled and the stake refunded. In the event of a dead heat in one or more selections in a multi, standard dead heat rules apply (see section 7.4 for more details).
- In the event of a runner being scratched in the same race as a multi selection, deductions may apply (see section 7.7 for more details).
- In the event of a protest being upheld, a multi will be paid based on the final official placings. PointsBet’s protest payout will not apply to multis.
- n addition to single multiples, PointsBet enables you to create a single bet that is made up of a group of single and multiple bets within a group of selections (Combo Multis). These Multis are defined as follows:
a. Double - A bet on two selections, both of which must win for the bet to be successful.
b. Treble - A bet on three selections, all of which must win for the bet to be successful.
c. 4-fold - A bet on four selections, all of which must win for the bet to be successful.
d. 5-fold - A bet on five selections, all of which must win for the bet to be successful.
e. 6-fold - A bet on six selections, all of which must win for the bet to be successful.
f. 7-fold - A bet on seven selections, all of which must win for the bet to be successful.
g. 8-fold - A bet on eight selections, all of which must win for the bet to be successful.
h. Trixie - A bet on three selections that consists of four separate bets: 3 x Doubles, 1 x Treble. At least 2 legs must win for a bet return to be paid.
i. Yankee - A bet on four selections that consists of 11 separate bets: 6 x doubles, 4 x trebles, 1 x 4-fold. At least 2 legs must win for a bet return to be paid.
j. Super Yankee - A bet on five selections that consists of 26 separate bets: 10 x doubles, 10 x trebles, 5 x 4-folds, 1 x 5-fold. At least 2 legs must win for a bet return to be paid.
k. Patent - A bet on three selections that consists of seven separate bets: 3 x singles, 3 x doubles, 1 x treble. At least 1 leg must win for a bet return to be paid.
l. Lucky 15 - A bet on four selections that consists of 15 separate bets: 4 x singles, 6 x doubles, 4 x trebles, 1 x 4-fold. At least 1 leg must win for a bet return to be paid.
m. Lucky 31 - A bet on five selections that consists of 31 separate bets: 5 x singles, 10 x doubles, 10 x trebles, 5 x 4-folds, 1 x 5-fold. At least 1 leg must win for a bet return to be paid.
n. Lucky 63 - A bet on six selections that consists of 63 separate bets: 6 x singles, 15 doubles, 20 trebles, 15 4-folds, 1 x 6-fold. At least 1 leg must win for a bet return to be paid.
o. Super Heinz - A bet on 7 selections that consists of 120 separate bets: 21 x Doubles, 35 x Trebles, 35 x 4-Folds, 21 x 5-Folds, 7 x 6-Folds, 1 x 7-Folds. At least 2 legs must win for a bet return to be paid.
p. Goliath - A bet on 8 selections that consists of 247 separate bets: 28 x Doubles, 56 x Trebles, 70 x 4-Folds, 56 x 5-Folds, 28 x 6-Folds, 8 x 7-Folds, 1 x 8-Fold. At least 2 legs must win for a bet return to be paid.
- Same Game Multi Combo (SGM Combo): PointsBet allows customers to combine Same Game Multi (SGM) bets with other eligible SGM bets or other eligible single bets to form an SGM Combo bet. Payout is subject to settlement conditions of each individual leg of the SGM Combo bet. If an individual leg of a SGM within a SGM Combo bet is void, the SGM Combo bet will still stand but at a recalculated price without the void SGM Combo leg(s).
3.13 Hourly Quaddie
- Definitions:
a. Leg: An individual race which forms part of an Hourly Quaddie card. b. Combination (Combo): A possible outcome of an Hourly Quaddie bet. c. Stake per Combo: The total stake wagered by a Member on an Hourly Quaddie bet divided by the number of possible Combinations. d. Starting Price (SP): For each selected runner in an Hourly Quaddie bet, the ‘starting price’ as determined by the Australian Prices Network (APN). Or, if for any reason the APN starting price is unavailable to PointsBet, the PointsBet Fixed Odds Win market price available at the jump for each selected runner incorporated into a Hourly Quaddie bet.
- Hourly Quaddie is a new type of multi bet product that allows Members to place Quaddie style bets on select racing contingencies (races) within a one-hour period (AEST / AEDT) nominated by PointsBet at regular intervals. PointsBet makes no guarantee as to the availability of Hourly Quaddie, including the number of Hourly Quaddie card’s that may be available on a given day. If the Hourly Quaddie product is available at any given time, it will be accessible via the PointsBet homepage or racing page in the website or app.
- Hourly Quaddie is not a traditional parimutuel betting product and no ‘pools’ are used to determine payouts for successful Hourly Quaddie bets, instead, if your Hourly Quaddie bet is successful your payout will reflect the relevant multi bet odds for that bet.
- PointsBet will use reasonable endeavours to ensure that each Hourly Quaddie card will be available for betting 2 hours before the first Leg is scheduled to jump, however makes no guarantee concerning the same. Each leg of an Hourly Quaddie card will be nominated by PointsBet using its sole discretion. PointsBet reserves the right to (i) remove and replace a Leg, or (ii) remove an entire Hourly Quaddie card at any time prior to the jump of the first Leg. Bets placed prior to removal and replacement of a Leg or removal of an entire Hourly Quaddie card will stand, unless some other PointsBet Term and Condition applies.
- To place an Hourly Quaddie bet, a Member must: a. Select the Hourly Quaddie card. b. Pick at least one runner in each Leg. c. Review the bet in the betslip, select the desired stake and place the bet.
- At the time of bet placement, as the final SP for each selected runner is not known until the jump of each Leg, the stake per Combo will be displayed but no estimated return. The eventual odds (combined price) of a successful Hourly Quaddie bet will be displayed once the bet is settled as a winner.
- Each Leg of an Hourly Quaddie bet will result separately. An Hourly Quaddie bet will result as a winner if a Member’s selections include the eventual winner in each of the 4 Legs; bets with 0-3 successful Leg selections will not be successful bets.
- The payout for a winning Hourly Quaddie bet is calculated as follows: Payout = Winner SP (Leg 1) x Winner SP (Leg 2) x Winner SP (Leg 3) x Winner SP (Leg 4) x Stake per Combo
- Scratchings: If a runner selected by a Member in any Leg of a Hourly Quaddie bet is scratched, the same rules as apply for ordinary multi bets apply – refer to 3.12.5.
- Abandoned Races: If a race included in any Hourly Quaddie card is abandoned after bet placement, the same rules as apply for ordinary multi bets apply – refer to 3.12.5.
- Deductions: If deductions apply to any Leg of a Hourly Quaddie card, but those deductions have not been applied to the Fixed Odds win market for that race prior to the jump (e.g., because of a late scratching) and the bet is ultimately a winning bet, PointsBet reserves the right to manually adjust the payout to reflect the revised SP (taking into account the deductions) for the relevant Leg.
- PointsBet reserves the right to modify, suspend or cancel the Hourly Quaddie product at any time, including (for example) by removing the product from individual Members. All decisions made by PointsBet regarding the Hourly Quaddie product are final.
- In addition to this 3.13, the full PointsBet Terms and Conditions apply to Hourly Quaddie bets.
4. PROMOTIONAL TERMS & CONDITIONS
In addition to our Terms of Use and other Terms and Conditions, the following terms and conditions apply to all First Bet Match, Deposit Match, Bonus Bets and other promotions or offers (collectively, “Promotional Offers”) that we may, in our absolute discretion, offer or provide to you from time to time.
4.1 GENERAL
- You agree to be bound by these Promotional Terms and Conditions and any additional terms and conditions (including eligibility requirements) by participating in any Promotional Offer or accepting any benefit from a Promotional Offer.
- Any reference to a time is Australian Eastern Daylight Time or AEDT.
- All Promotional Offers are in Australian dollars unless specifically stated otherwise.
- Any Promotional Offer conducted by Facebook, Twitter or other social media platform is not sponsored or endorsed by that social media platform.
4.2 GENERAL ELIGIBILITY REQUIREMENTS
- You are eligible to participate in a Promotional Offer when you satisfy these Promotional Terms and Conditions or any additional or replacement terms and conditions (including eligibility requirements), for example, those contained in our marketing, communications or online Betting Platforms for that type of Promotional Offer.
- You are eligible for one (1) bonus per person, Account, household, residence, address (but not a PO Box or business address), internet connection (for example IP address), computer, mobile device and payment method (for example, a specific debit card or bank account.)
- You are eligible to redeem only one (1) Promotional Offer per day. In the event that you have received more than one (1) Promotional Offer, we will (in our absolute discretion) permit you to redeem only one (1) of those.
- Promotional Offers are not transferable. If you receive a Promotional Offer, you are not permitted to transfer it to anyone else.
- If there is a discrepancy between the name associated with your Account and the name associated with your deposit method (e.g. debit card holder), you may be ineligible for a Promotional Offer and the Promotional Offer may be withdrawn or invalidated.

- PointsBet reserves the right to remove any promotional offers provided at any time if PointsBet reasonably believe the customer is abusing the spirit of promotion.
- PointsBet reserves the right to exclude certain and any members from participating in promotions.
4.3 DEPOSIT BONUS
- If you are eligible, you may be offered a Deposit Bonus offer.
- You will receive Bonus Bets equal to the specific Deposit bonus offer allocated to your account. For example, if the Deposit Bonus offer for a member is 25%, and you have deposited $1000 AUD, you will receive $250 worth of Bonus bets in your account.
- Other requirements in relation to the Deposit Bonus are set out in section below.
4.4 DEPOSIT BONUS DETAILS
- Typically deposit bonuses will be credited within 60 minutes of placing your initial deposit however it can take up to 24 hours.
- Using a Deposit Bonus or part thereof as any component of a ‘no loss wagering proposition’ is strictly prohibited. ‘No loss wagering proposition’ includes placing bets on all likely outcomes of an event, equal or zero margin bets and hedge betting. Bets wagered in this manner will be considered ‘irregular bets’ and may be cancelled and forfeited at our discretion.
- The Deposit Bonus may be used as a single bet on eligible fixed odds markets.
- If you are eligible for a deposit bonus, your deposit must be made via an approved deposit method. If you deposit directly from your bank account, PointsBet at its sole discretion, may require that you provide proof that funds have been deposited directly from a bank account belonging to the account holder.
- You are permitted to use the Deposit Bonus for multiple bets on the same fixed odds event
4.5 MONEY BACK PROMOTIONS - GENERAL
- Any money back promotions can not be used in conjunction with a STOP LOSS function. Any bets placed on a money back promotion using a stop loss will not be deemed eligible for the promotion
- Any money back promotions will be void if a customer has a bet on the opposite side of the same market.
- Unless otherwise stated, money Back promotions are for a customers’ first bet on a specific market ONLY.
- Unless otherwise stated, money back promotions are for losses, not stake.
- Unless otherwise stated, Bonus Bets will not be eligible for money back promotions.
- PointsBet reserve the right to exclude any customers from Money Back promotions at any time.
4.6 BONUS BET OFFERS - GENERAL
- If you have received a Bonus Bet, the Bonus Bet will be visible in your Account under "Bonus Bets".
- To redeem the Bonus Bet, when logged into your Account, you must select the ‘Bonus Bet’ checkbox from within the bet slip before placing your bet.
- If you are logged in to the Website, and a market has the "Bonus Bet" checkbox available on the betting slip, the Bonus Bet can be placed on that market. Events may have restrictions preventing you from placing two wagers including the Bonus Bet on the same bet market.
- The Bonus Bet must be used within 7 days from the time that it is credited to your Account unless otherwise stated in the offer T&C's.
- If the Bonus Bet is not used within that time, it will become void and unable to be redeemed.
- The Bonus Bet will only be available for use on Fixed Odds Racing Markets and in accordance with the specific terms of the Offer.
- Bonus Bets are not transferrable or exchangeable other than in PointsBet's sole discretion.
- The Offer must not be used in conjunction with any other offer made available by PointsBet.
- This Offer is only open to bona fide Account holders, who act at all times in good faith, with integrity, who place bets with PointsBet for the purpose of recreation and entertainment, and who comply with PointsBet's General Rules and these Bonus Bet Terms.
- PointsBet reserves the right to cancel or change the Offer at any time throughout the Offer Period by amending the specific terms of the Offer or these Bonus Bet Terms. The decisions of Management are final. No correspondence will be entered into.
4.7 BONUS BET WINNINGS
- Should your Bonus Bet be successful, only the winnings from the Bonus Bet will be credited into your Account. This means that your winnings will exclude the initial Bonus Bet stake. For example, a winning $50 Bonus Bet placed on a selection paying $3.00 will credit winnings of $100 into your Account. The $50 Bonus Bet stake will not be returned.
4.8 DOUBLE WINNING PROMOTIONS
- Any double winnings promotions cannot be used in conjunction with a STOP LOSS function. Any bets placed on a double winnings promotion using a stop loss will not be deemed eligible for the promotion.
- Any double winning promotions will be void if a customer has a bet on the opposite side of the same market.
- Unless otherwise stated, Double Winning promotions are for a customers first bet on a specified market ONLY.
4.9 BOOSTER AND BEAST MODE TERMS AND CONDITIONS
- PointsBet's 'Booster' feature and ‘Beast Mode’ features (“Boost Features”), and any bets where Boost Features are available, are governed by these Rules and the additional rules described here (the “Booster Terms and Conditions”). In the event of any inconsistency between these Rules and the Booster Rules, the Booster Rules will prevail to the extent of the inconsistency.
- These rules (the “Booster Rules”) are incorporated into and form part of the Rules. The standard sports and racing rules, including deductions, also apply to bets placed using Boost Features.
- The number of Boosters or Beast Mode sessions which may be made available to you in a particular day will vary depending on a range of factors, and no correspondence will be entered into regarding this.
- Boosters are not available on all markets, but restricted to a selection of markets as determined by PointsBet. A Beast Mode session may be available to you on any, all or a selection of markets as determined by PointsBet – at the time of activating a Beast Mode session (refer to rule 4.9(16) below), PointsBet will notify you (i) of the duration that Beast Mode will be available for, and (ii) what market or markets Beast Mode will be available in conjunction with.

- Booster promotions and Beast Mode is only available to recreational gamblers who always act in good faith and without fraud in accordance with the PointsBet Terms & Conditions. Boosters and Beast Mode are not available to arbitrage or professional punters.
- The price available to you when you apply your Booster feature or Beast Mode session will be at PointsBet's absolute discretion.

Booster features:
Your Booster will be considered to have been used and will not be available for any other bets that day if:
a. your Booster bet (or any part of your Booster bet) is declined for any reason;
b. your Booster bet is voided or your bet selection is scratched; or
c. you have a screen timeout while your Booster bet is being processed and before your Booster bet is accepted.Beast Mode:
d. If a Beast Mode session is available to you in the PointsBet website or app while you are logged in to your Account.
e. To activate a Beast Mode session that is available to you, select the ‘Beast Mode icon’, review the terms and conditions for that Beast Mode session and, if desiring to participate, select the button to activate.
f. Once activated, the counter will show you how much time remains before your Beast Mode session will expire. Once you have selected the Beast Mode button, Beast Mode is automatically activated and that Beast Mode session will no longer be available to you to activate.
g. While Beast Mode is activated on your Account, eligible markets will display the new Beast Mode odds in addition to the ordinary (non-Beast Mode) odds. Beast Mode odds are only available to you for the period during which a Beast Mode session is activated. Beast Mode odds only apply to an applicable bet if that bet is placed by the Customer and confirmed by PointsBet prior to the expiry of a Beast Mode session. Bets not confirmed by PointsBet prior to expiry of a Beast Mode session will, if confirmed, automatically be placed at the ordinary odds for that applicable market. It is the responsibility of each Customer to be aware of the Beast Mode expiry time prior to placing a bet.
h. Beast Mode is only available for fixed odds singles. Multi, SGM, SGM Combo and SRM bets are not eligible to be used with Beast Mode. Unless otherwise notified by PointsBet, other bet types are not eligible for Beast Mode bets. -
PointsBet reserve the right, acting reasonably, to refuse your participation or disqualify you from participating in:
- Opening an account with us;
- Placing a bet with us;
- Using any of our Betting Platforms; or
- Using Boost Features where your usage, betting activity, and volume indicate that you have breached, abused, undermined, or otherwise operated your account in contravention of the PointsBet Terms and Conditions and/or the General Betting Rules, any additional terms and conditions, the spirit or intent of Promotional Features, or any of our other Terms and Conditions.
(2) PointsBet may, in its absolute discretion, offer Boost Features to selected Members for selected products, markets, pricing or bet types. PointsBet reserves the right to change, suspend or remove the availability of a Boost Feature at any time.
- PointsBet reserves the right to void any bets placed using the Boost Features if there has been an obvious and manifest error by PointsBet and/or a breach of any of the Terms and Conditions by the Customer.
- To avoid the abuse of promotions offered by us from time to time, unless otherwise stated by PointsBet, Boost Features are not available for use in conjunction with promotions including, but not limited to, bonus bets, bets placed using non-withdrawable funds or any bets placed which would qualify customers to receive a bonus bet, bonus or promotion.
- Bets placed in conjunction with Boost Features are subject to our other Terms and Conditions. Our standard customer restrictions and liability and trading limits also apply to bets placed using Boost Features.
- A bet placed in conjunction with a Boost Feature is not considered accepted until you receive a bet confirmation. In the event of any failure or malfunction, a bet may be paid at the regular odds for the applicable betting contingency.
- PointsBet reserves the right to amend, suspend or remove the availability of all or any Boost Features at any time on any market or to any Customer.
- Minimum bet laws do not apply to bets placed using Boost Features.
4.10 INELIGIBILITY AND IRREGULAR BETS
- If at any time we determine that you are ineligible to participate in any Promotional Offer or have breached, abused or undermined these Promotional Terms and Conditions (including eligibility requirements) or our General Rules or other Terms and Conditions, or the spirit or intent of the Promotional Offer, we reserve the right to refuse your participation in that Promotional Offer, disqualify you from participating in that Promotional Offer, and cancel, void or reverse any relevant bet.
- Irregular bets and irregular betting patterns include, but are not limited to, placing bets on all likely outcomes of an event, equal or zero margin bets, hedge betting and placing single bets using the entire (or majority) of your Account balance on a single bet where the majority of your Account balance is derived from Promotional Offers.
- Irregular bet types and irregular betting patterns continue to evolve. We reserve the right to determine what is or may constitute an irregular bet or irregular betting pattern in our sole discretion.
- Before any withdrawals are processed from your Account where you have taken advantage of a Promotional Offer, all bets will be reviewed for any irregular bets and irregular betting patterns.
- We may withhold any withdrawal where an irregular bet or irregular betting pattern has been identified.
- We reserve the right to cancel and void any bet, regardless of whether it relates to a Promotional Offer or not and regardless of whether it is pending or resulted, where we determine that the bet is an irregular bet or there is an irregular betting pattern.
4.11 MODIFICATION AND WITHDRAWAL OF PROMOTIONAL OFFERS
- We may modify or withdraw the types of Promotional Offers that we make available at any time without prior notice.
- We may also withdraw any Promotional Offer at any time without prior notice.
4.12 DISPUTES
- Any disputes regarding any Promotional Offer should be escalated in accordance with our Dispute Resolution Process at Section 1.13 of our General Rules.
4.13 SEVERABILITY
- Each clause within these Promotional Terms and Conditions is severable from this document. If a clause is found to be void, invalid or unenforceable for any reason, the remaining clauses remain in full force and effect

6.2 Membership of PointsBet Rewards

6.3 Your Warranties

g. Have provided us with personal details that are valid, accurate, and complete in each and every respect and that You will advise us immediately via e-mail should any such details change;
h. Are wholly responsible for the secrecy of Your username and password;

- In the event that any of the warranties set out in clause 3.1 prove to be false, PointsBet reserves the right to terminate Your membership and void any Points.

6.4 Rewards Points
- Subject to these Terms and Conditions, Members with a PointsBet wagering account can earn Points for wagering turnover on their PointsBet account in the form of a rebate of a proportion of their bet stake for all real money resulted bets with PointsBet.
- Points are earned at the rate specified on the Rewards Page. The rate at which Points are earned varies by bet type.
- PointsBet reserves the right to at any time change the rate at which Points are earned.
- Bonus Bets and bets on promotional markets will not earn Points.
- Points are credited on the settlement of eligible bets.
- No Points are earned on bets that are voided, scratched or otherwise cancelled.
- The Member is not permitted to accrue Points as a result of any activity by a person other than the Member. PointsBet may, in its discretion, permanently remove all Points earned in contravention of this rule.
- PointsBet will not be liable in any way in relation to the unavailability of Points or the incorrect accumulation of Points as a result of a technical malfunction, operator fault, misrepresentation for which it is not responsible, or any other reason outside of PointsBet's control.
- PointsBet may limit, cap or exclude the earning of Points for any Member or in respect of any Promotional Activity at its discretion.
- Points may not be transferred, converted or redeemed for cash.
- Points may be subject to personal income or other tax assessment. Members are advised to check with their accountant or tax adviser for further information. PointsBet does not accept responsibility for and makes no representation about Members’ tax liability as a result of participating in PointsBet Rewards.
- If a Member does not register a transaction with PointsBet for any continuous period of six months or more, PointsBet reserves the right to cancel the Member’s Points. For the purposes of this clause, a transaction includes a real money bet or a deposit into the Member’s PointsBet account or a redemption of Points.
6.5 Redeeming Rewards Points For Bonus Bets
- Subject to these Terms and Conditions, Members with a PointsBet wagering account may redeem their Points for Bonus Bets in which case the Bonus Bet Rules will apply.
6.6 Suspension Or Termination Of Membership
- PointsBet in its discretion may immediately terminate and/or suspend (at PointsBet's option) a Member’s PointsBet Rewards membership, ability to earn Points and/or cancel any Points which that Member has accrued, if any of the following occur:
- We suspect You are in breach of the Terms and Conditions; or
- We consider that You present a liability risk to our business that we have deemed is unacceptable at our absolute discretion; or
- any of the warranties provided at clause 3 proves to be false; or
- We suspect that Your conduct (whether directly or indirectly) is dishonest, fraudulent or offensive; or
- the death, or bankruptcy of the Member; or
- the Member becomes an employee of PointsBet; or
- the Member breaches the rules of any Promotional Activity; or
- PointsBet is required to do so by operation of law.
- In the event that a membership is terminated, at PointsBet’s discretion, Members may be permitted to redeem their accrued Points for Bonus Bets.
- PointsBet reserves the right to seek criminal and contractual remedies and sanctions against Members who are involved in fraud, dishonest or criminal acts and will make such reports as necessary.
6.7 Changes To PointsBet Rewards Terms and Conditions
- PointsBet may amend these Terms and Conditions from time to time at its discretion.
- PointsBet will use its best endeavours to provide notice to Members of any changes to the Terms and Conditions or the PointsBet Rewards program where there is a material effect on the Members by providing at least 14 days’ notice.
- It is the Member’s responsibility to ensure that they keep up to date with the Terms and Conditions and the features and requirements of PointsBet Rewards by reviewing the PointsBet website.
6.8 Liability
- Nothing in these Rules is intended to affect any rights that a Member may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law which cannot be excluded.
- To the extent permitted by law, PointsBet and its Related Bodies Corporate (including its officers, employees, agents and contractors) is not and will not be liable for any damages or any other loss incurred by the Member (including consequential loss), either directly or indirectly in connection with PointsBet Rewards Terms and Conditions or the PointsBet Rewards program (including, without limitation, changes to the Terms and Conditions or the PointsBet Rewards program), except to the extent caused by the negligence, wilful misconduct, act or omission of PointsBet and its Related Bodies Corporate or its officers, agents or employees.
6.9 Activity Statements
- Members may access account information and their PointsBet Rewards activity statement on the PointsBet Rewards page.
6.10 Termination of PointsBet Rewards
- PointsBet reserves the right to suspend the operation of PointsBet Rewards or cease to operate PointsBet Rewards at any time.
- Should PointsBet Rewards cease to operate, all Points which have not been exchanged for currently available Rewards within three (3) months of PointsBet issuing a notice to Members that PointsBet Rewards will cease to operate and will be cancelled.
6.11 Privacy
- Members agree to comply with our privacy policy. All Members’ personal information will be handled in accordance with PointsBet's privacy policy, accessible at https://support.pointsbet.com.au/hc/en-au/articles/15152096947983-Privacy-Policy.
6.12 General
- PointsBet's decisions in respect of PointsBet Rewards are final and binding.
- For the avoidance of doubt, PointsBet reserves its right to waive in respect of any Member or Members (at our absolute discretion) any right or requirement of these Terms and Conditions and/or the application of, or compliance with any of these Rules. Any such waiver does not operate as a waiver of such right, requirement, application or compliance if it arises again.
- These Terms and Conditions, and the agreement of which they form part of, are governed by the laws of the state of Victoria.
- To the extent that any provision in these Terms and Conditions is illegal or unenforceable, it is severed without affecting the validity or enforceability of the remaining Terms and Conditions.
7. PAYBACK
7.1 GENERAL
- Pay Back gives you the chance to get your stake (up to an eligible amount nominated by PointsBet) returned in Bonus Bets if your eligible cash:
- Fixed-Odds Win racing bet finishes in the selected positions specified for an applicable race (Racing Pay Back); or
- Same Game Multi bet for an applicable event does not win, but fails by the selected number of leg(s) nominated by PointsBet (SGM Pay Back); or
- Same Race Multi bet for an applicable event does not win, but fails by the selected number of leg(s) nominated by PointsBet (SRM Pay Back);
- Multi bet (Including Same Game Multi Combo) does not win, but fails by the selected number of leg(s) nominated by PointsBet (Multi Pay Back)
- Pay Backs will be displayed in the ‘Account’ menu found at the top righthand corner of the website or app when you are logged in. If you have used all your Pay Back tokens, or you have not been allocated any Pay Back tokens by PointsBet (using its sole discretion), no Pay Back tokens will be visible in your Account. PointsBet reserves the right to offer as many or as few Pay Back tokens (including none) to any client as it chooses using its sole discretion.
- Racing Pay Backs are only available to be used:
- on select Thoroughbred, Harness & Greyhound Races with a minimum of 8 runners;
- on Fixed-Odds Win bets placed using cash only;
- a maximum of once per Race only; and
- on Races which are scheduled to take place on the same day as bet placement.
- SGM Pay Backs are only available to be used:
- on select sporting events nominated by PointsBet;
- on Same Game Multi bets placed using cash only;
- unless otherwise stated by PointsBet in relation to a specific SGM Pay Back token, on eligible Same Game Multi bets comprising a minimum of three (3) legs at a minimum total odds of three dollars ($3); and
- a maximum of once per sporting event only.
- SRM Pay Backs are only available to be used:
- on select Thoroughbred, Harness & Greyhound Races with a minimum of 8 runners;
- on Same Race Multi bets placed using cash only;
- a maximum of once per Race only;
- on Races which are scheduled to take place on the same day as bet placement; and
- unless otherwise stated by PointsBet in relation to a specific SRM Pay Back, on eligible Same Race Multi bets comprising a minimum of three (3) legs at a minimum total odds of two dollars ($2).
- Multi Pay Backs are only available to be used on eligible Multi bets (Including Same Game Multi Combo):
- nominated by PointsBet;
- that are placed using cash only; and
- unless otherwise stated by PointsBet in relation to a specific Multi Pay Back token, that comprise a minimum of three (3) legs at a minimum total odds of three ($3) dollars.
- Pay Backs are not available to be used on, Exotic, Telephone or Live Bets. PointsBet reserves the right (at its sole discretion), without further notice, to make Pay Back available to any or all clients from time to time on select markets or bet types other than as stated at 7.1.3, 7.1.4 and 7.15 above.
- Unless otherwise stated by PointsBet in its sole discretion, Pay Backs must be used by you on the same day that they are allocated to your Account by PointsBet and expire at midnight. Expired (including where an alternate expiry date and/or time is nominated) or unused Pay Backs do not accumulate and will disappear from your Account.
- Pay Backs cannot be used in conjunction with Bonus Bets or any other promotion, including without limitation Boosters.
7.2 SETTLEMENT AND RESULTING
- For Racing Pay Backs:
- If a protest is upheld and your selection is relegated to 4th place, you will not receive a Bonus Bet. If your selection finishes 2nd or 3rd but is promoted to 1st place as a result of an upheld protest, you will also not receive a Bonus Bet (however in that case your bet will be paid as a winning bet).
- If your selection is scratched, your Pay Back will be re-credited to your Account. In that instance, PointsBet will endeavour to re-credit the Pay Back to your Account within 24 hours.
- Where you have used a Pay Back on a bet that is later cancelled, voided or where your selection is scratched after placing the bet, the Pay Back will be re-credited to your Account however that Pay Back will not be available to be used again on the same race.
- For SGM Pay Backs:
- If the sporting event on which you have placed a bet using a SGM Pay Back is cancelled or rescheduled to a different day, PointsBet (in its sole discretion) may re-credit the SGM Pay Back to your Account.
- If any leg of a Same Game Multi bet you place using a SGM Pay Back becomes void on the same day on which you placed the relevant bet, your SGM Pay Back may (in PointsBet’s sole discretion) be re-credited to your Account.
- If you opt to fully cash out a Same Game Multi bet you place using a SGM Pay Back, no Bonus Bets will be awarded to your Account if the Pay Back criteria are met and the relevant SGM Pay Back will not be re-credited to your Account. Same Game Multi bets placed using a SGM Pay Back which are partially cashed out remain eligible for Bonus Bets up to the lesser amount of (i) the reduced stake amount after the partial cash out, or (ii) the applicable cap nominated for the relevant SGM Pay Back.
- For SRM Pay Backs:
- If a protest is upheld and your selection is relegated, you will not receive a Bonus Bet.
- If any of your selections are scratched, your Pay Back will be re-credited to your Account. In that instance, PointsBet will endeavour to re-credit the Pay Back to your Account within 24 hours.
- Where you have used a SRM Pay Back on a bet that is later cancelled, voided or where any of your selections are scratched after placing the bet, the SRM Pay Back will be re-credited to your Account however that Pay Back will not be available to be used again on the same race.
- For Multi Pay Backs:
- In relation to any leg or legs which are racing contingencies, (i) a protest is upheld and your selection in relation to all or any legs is relegated, you will not receive a Bonus Bet and (ii) if your selection is scratched, your Pay Back will be re-credited to your Account by PointsBet using its reasonable endeavours to do so within 24 hours.
- In relation to any leg or legs which are sports contingencies, without limitation, the rules outlined at 7.2.2 apply.
- Some Pay Backs are eligible for one or more specific events only. These Pay Back’s will be visible in the bet slip at the time of placing an eligible bet, and will be pre-selected. If you do not want to use your Pay Back on a particular event (e.g., you want to use a Booster), it is your responsibility to de-select use of the token before placing your eligible bet. If you do not use a Pay Back for the specific event or event(s) relating to which it has been allocated, that Pay Back will expire and cannot be used for bets on any other event.
- PointsBet will endeavour to credit your Account with (i) the Bonus Bets from a successful Pay Back within 24 hours of the completion of the event, or (ii) re-credited Pay Back’s (if re-credited pursuant to 7.2.1 and 7.2.2) within 24 hours of the event giving rise to the re-crediting.
- Winning bets placed with Pay Backs will not result in the relevant Pay Back being re-credited to your Account.
- Bonus Bets awarded to your Account as a result of a bet placed with a Pay Back token expire after 7 days.
- Pay Backs are only available to eligible clients determined by PointsBet.
- Full PointsBet Terms & Conditions also apply, including those relating to availability of promotional offers and Bonus Bets. If PointsBet believes you have not complied with the PointsBet Terms & Conditions, it reserves the right to void or cancel relevant bets without re-crediting Pay Backs.
- PointsBet reserves the right to, at any time, exclude any client(s) from being eligible to use Pay Backs, or to amend these Pay Back terms and conditions or to cease offering Pay Back tokens altogether without further notice.
8. 5FOR$25
- 5FOR$25 is new fast and easy way to place a same game multi on two sided markets (usually, Over/Under contingencies) for nominated sporting or racing events. Available at PointsBet’s discretion, and only for nominated sporting or racing events.
- If 5FOR$25 is available for a sporting event, or a series of racing events, it will be accessible to Members who are logged in to their Account on the homepage and/or the event page for the sporting event, commencing from approximately 3 hours before the advertised start time for that sporting event. 5FOR$25 same game multis may be published, changed and removed from the website at any time, in PointsBet’s discretion.
- To place a bet using 5FOR$25, simply answer ‘more’ or ‘less’ (or 'yes' or 'no') to the 5 questions (Questions) and the betslip will automatically populate with your same game multi bet comprising 5 legs; one leg for the corresponding market relevant to each of the 5 Questions, and the final odds will always be $25. Then, enter your stake and select ‘place now’. You will receive a confirmation receipt once the bet is placed.
- Questions are nominated by PointsBet and are subject to change at any time prior to bet placement or movement of the underlying handicap / line for an applicable market. If a Question has changed, bets including removed Question(s) are no longer available. It is a Member’s responsibility to review and confirm their selections for each leg of the same game multi in the betslip prior to placing the bet.
- 5FOR$25 bets are not available for same game multi combos. They can be placed using bonus bets and Pay Backs. However you cannot use boosters and they cannot be combined with any other promotions offered by PointsBet, unless otherwise expressly stated.
- Cash outs are not available on 5FOR$25 bets.
- 5FOR$25 bets will be resulted in accordance with the applicable rule or condition for same game multis, unless otherwise expressly stated including (without limitation) where one or multiple legs are void. For the avoidance of doubt, if one or multiple legs of a 5FOR$25 bet is void, the entire bet will be voided and the stake returned to the Member’s Account.
- PointsBet reserves the right to impose stake limits on any Member for 5FOR$25 bets in accordance with these terms and conditions.
9. PULL EM
9.1 Overview
- Pull 'Em is a new way to place a Same Game Multi (SGM) on selected markets for nominated sports or sporting events. It is available at PointsBet's absolute discretion and only for nominated sports or sporting events.
- If Pull 'Em is available for a sporting event, it will be displayed and available to Members at the time of placing an eligible cash-only Same Game Multi bet that comprises, unless otherwise stated by PointsBet, a minimum total of 4 legs (including at least 1 Eligible Leg) and minimum total odds of $5 (a "Pull 'Em SGM").
- Pull 'Em must be applied in the bet slip at bet placement and is available for one bet per underlying sporting event.
9.2 Removing an Eligible Leg
- Customers who place a Pull 'Em SGM may choose to remove a single Eligible Leg from that bet at any point prior to the nominated time or occurrence in the underlying sporting event.
Unless otherwise stated by PointsBet, the nominated time or occurrence will be:
- AFL - Before the 3rd quarter commences
- NBA - Before the 3rd quarter commences
- NFL - Before the 3rd quarter commences
- Soccer (listed competitions below) - Before the end of half time

- PointsBet may, in its discretion, nominate an alternative time or occurrence for the underlying sporting event. This will be displayed to Members at bet placement.
- To remove an Eligible Leg from a Pull 'Em SGM:
- The Member must select the relevant leg in the pending bet list.
- PointsBet will recalculate the bet at reduced odds.
- The Member must confirm the pulled leg and accept the reduced bet odds before the nominated expiry time.
- PointsBet reserves the right to impose stake limits on any Member for Pull 'Em SGM bets.
9.3 Member Acknowledgements
- By placing a Pull 'Em SGM you acknowledge that:
a. A request to remove an Eligible Leg is final, non-cancellable, and cannot be recalled.
b. You may only remove an Eligible Leg prior to the nominated time or occurrence in the underlying sporting event. Requests not successfully processed before that time will not be completed by PointsBet.
c. Acceptance of a recalculated Pull 'Em SGM bet is an agreement to vary your bet and does not represent a new bet.

- Pull 'Em SGM bets:
- May only be placed online;
- Are not available for telephone bets; and
- Are not available when using Bonus Bets.

- Boosters
- Promotions
- Cash outs are not available for Pull 'Em SGM bets.
- If any leg of a Pull 'Em SGM bet becomes void:
- The bet will be refunded; and
- If the underlying sporting event has not yet commenced, customers may (at PointsBet's discretion) be able to place a new Pull 'Em SGM bet on that sporting event.
- PointsBet reserves the right (at its sole discretion), without further notice, to:
- Make Pull 'Em available to any or all clients from time to time;
- Exclude any client(s) from eligibility;
- Amend these Pull 'Em terms and conditions; or
- Cease offering Pull 'Em altogether.
- PointsBet is not liable for any loss incurred in connection with:
- Your use of Pull 'Em; or
- Your acceptance of recalculated odds for a Pull 'Em SGM bet.
